• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

Orders and Payments

1. Placing Orders

By placing an order through our App, you agree to provide accurate and complete information. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion. In the event of a refusal or cancellation, we will notify you and provide a full refund if payment has already been made.

2. Payment

You agree to pay all fees and charges associated with your orders. We use third-party payment processors to facilitate transactions. By providing your payment information, you authorize us to charge your payment method for the total amount of your order, including any applicable taxes and fees

3. Delivery

We strive to deliver orders in a timely manner. However, we are not responsible for any delays or failures in delivery caused by factors beyond our control, such as inclement weather, natural disasters, or third-party service interruptions. You are responsible for providing accurate delivery information. We will not be liable for failed deliveries due to incorrect or incomplete information provided by you.

4. Refunds and Cancellations

Refunds and cancellations are subject to our Refund and Cancellation Policy, which is available on our App. Please review the policy for detailed information on eligibility and the process for requesting a refund or cancellation.

Subscription Services

1. Subscription Plans

We offer subscription plans for our delivery services. By subscribing, you agree to the terms of the subscription plan, including the payment of recurring fees. Subscription plans may vary in duration and features, and we reserve the right to modify or discontinue subscription plans at any time

2. Billing and Renewal

Subscription fees will be billed in advance on a recurring basis according to the terms of your selected plan. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. You authorize us to charge your payment method for the renewal fee at the applicable rate.

3. Cancellation

You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of the current billing cycle. We do not offer refunds for partial billing periods. After cancellation, you will continue to have access to the subscription services until the end of the current billing cycle

Driver Application and Personal Information

1. Information Required

If you apply to become a delivery driver with Rushing 2 Your Needs, you will be required to submit certain personal information, including but not limited to:

• A copy of your driver's license
• Your Social Security Number (SSN).
• Your banking routing and account numbers
• Information required for criminal background checks

2. Use of Personal Information

We use this personal information to:

• Verify your identity and eligibility to work.
• Conduct necessary background checks
• Process payroll and other related payments.
• Ensure compliance with legal and regulatory requirements

3. Privacy and Security

Your personal information is considered private and will be handled with the highest level of confidentiality. We implement strict security measures to protect your data, including encryption and access controls. For more details, please refer to our Privacy Policy.

User Content

1. Content Ownership

You retain ownership of any content you submit or post through our App ("User Content"). By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with our Services. This license ends when you delete your User Content or your account, unless your content has been shared with others and they have not deleted it.

2. Prohibited Content

You agree not to submit or post any User Content that:

• Is illegal, harmful, or offensive.
• Infringes on the intellectual property rights or privacy rights of others.
• Contains viruses, malware, or other harmful code.
• Is false, misleading, or defamatory
• Promotes violence, discrimination, or hatred.

We reserve the right to remove or disable access to any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

We do not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components. You use our Services at your own risk.

Indemnification

You agree to indemnify, defend, and hold harmless Rushing 2 Your Needs, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

Termination

We may terminate or suspend your account and access to our Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our Services will immediately cease. If you wish to terminate your account, you may do so by discontinuing your use of the Services.

You agree to submit to the personal jurisdiction of the courts located within that jurisdiction for the resolution of any disputes arising out of or relating to these Terms or your use of our Services.

Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of our Services shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the jurisdiction where Rushing 2 Your Needs operates, and the arbitrator's decision shall be final and binding. You agree to waive your right to participate in any class action or representative proceeding.

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on our App and updating the effective date at the top of the Terms. Your continued use of our Services after such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any changes.

These Terms constitute the entire agreement between you and Rushing 2 Your Needs regarding your use of our Services and supersede any prior agreements or understandings, whether written or oral.
